ProForge Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") govern your use of the ProForge app for iOS and Android and the services it connects to (together, "ProForge"). ProForge is operated by Burrak AI LLC ("we", "us", or "our"). By using ProForge you agree to these Terms. If you do not agree, do not use ProForge.

ProForge is separate from Burrak AI, our other product. It has its own accounts, credits and data, and these Terms — not the Burrak AI Terms of Service — apply to it.

2. Eligibility, guest use and accounts

You must be at least 13 years old to use ProForge. If you are under 18, or under the age of legal majority where you live, you may use ProForge only with the permission of a parent or guardian, who agrees to these Terms on your behalf.

You can start using ProForge without creating an account. A guest session is tied to the device it was started on: if you uninstall the app or sign out before creating an account, what you made and any credits left in that session may be lost and cannot be recovered. Creating a free account keeps them with you.

You are responsible for the information you provide, for keeping your sign-in credentials secure, and for all activity under your account. Tell us promptly at support@aqtoor.com if you believe your account has been used without your permission.

3. Acceptable use

We grant you a limited, non-exclusive, non-transferable, revocable licence to use ProForge for your personal or business purposes, subject to these Terms. You agree not to use ProForge to:

• Create sexual or sexually suggestive content involving a real, identifiable person, or any content that sexualises, exploits or endangers a minor. We report child sexual abuse material to the authorities.
• Create content depicting a real person without their consent, including content that impersonates them, places them in a false or degrading situation, or could be mistaken for a genuine photograph, recording or statement by them.
• Deceive people — for example by presenting generated media as real evidence, news or official communication — or commit fraud.
• Harass, threaten, defame or discriminate against anyone, or promote violence, self-harm or illegal activity.
• Infringe anyone’s copyright, trademark, privacy, publicity or other rights.
• Break the law or any rule of the app store you downloaded ProForge from.
• Obtain free credits improperly, for example by creating multiple guest sessions or accounts, or interfere with, overload or attempt to gain unauthorised access to ProForge or its systems.
• Reverse engineer or decompile ProForge, except where the law allows, or use it to build a competing product or train a competing model.

We may refuse a request, remove content, and suspend or end access that breaks these rules.

4. Photographs of people

Several tools, including AI Headshot, work from photographs of a person. Only upload photographs of yourself, or of someone who has given you their permission to use their image this way. Do not upload photographs of children.

You are responsible for having the rights and permissions needed for every photograph you upload. How we handle these photographs — including that we do not create biometric identifiers from them or use them to train models — is described in the ProForge Privacy Policy.

5. Your content and generated media

You keep ownership of the photographs and text you submit ("Your Content"). You give us a worldwide, royalty-free licence to host, process and transmit Your Content, and to send it to the providers that perform generation for us, only as needed to provide ProForge to you and as described in our Privacy Policy. We do not use Your Content or your results to train any model.

As between you and us, you own the images, video and audio ProForge generates for you ("Results"), to the extent the law allows anyone to own them, and you may use them for any lawful purpose. Because Results are produced by AI, they may not be eligible for copyright protection, other users may receive similar Results, and we do not guarantee that a Result is unique or that it does not resemble existing work.

Results can be inaccurate or unexpected — a generated portrait may not look exactly like you. Review a Result before you rely on it, and do not present it as an unaltered photograph where that would mislead.

6. How long we keep your media

Photographs you upload and the Results ProForge generates are deleted automatically 30 days after they are created. The app shows when each item will be deleted.

Save or download anything you want to keep before then. After deletion it cannot be recovered, and we are not responsible for media lost once its retention period has ended.

7. Credits and purchases

ProForge tools are paid for with credits. The price of each generation is shown in the app before you start it. Credits are deducted when a generation starts, and returned automatically if it fails, is cancelled or times out.

You can buy credit packs inside the app. Purchases are made through the Apple App Store or Google Play and are subject to their terms; the price you pay, including any tax, is set and shown by them. To buy credits you need a ProForge account, so that your credits stay with you if you reinstall the app or change device.

Purchased credits do not expire while your account exists. Credits are a licence to use ProForge features: they have no cash value, cannot be exchanged for money, and cannot be transferred to another account. Credits — including any free credits we give, which we may change or withdraw at any time — end when your account is deleted or terminated.

Refunds for purchases are handled by Apple or Google under their refund policies. If a refund is granted, the credits from that purchase may be removed from your balance.

8. Reporting content

You can report any Result from inside the app. We review reports and use them to improve what the tools will and will not make. If you believe ProForge has been used to create content of you without your consent, report it in the app or email support@aqtoor.com.

9. Intellectual property

ProForge, including its software, designs and trademarks, is owned by Burrak AI LLC or our licensors and is protected by intellectual property laws. Except for the licence in section 3 and your rights in Your Content and Results, these Terms do not transfer any rights in ProForge to you.

10. Third-party services

ProForge relies on third parties, including the AI providers that perform generation, Amazon Web Services for hosting, and Apple and Google for app distribution, sign-in and payments. We are not responsible for their availability or conduct, and your use of their services may be subject to their own terms.

11. App store terms

These Terms are between you and Burrak AI LLC, not Apple or Google. We, not Apple or Google, are responsible for ProForge, its content, its maintenance and support, and any claims relating to it. If you downloaded ProForge from the Apple App Store, your licence to use it is also limited to Apple-branded devices you own or control, as allowed by the App Store usage rules, and Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you.

12. Disclaimers

PROFORGE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not warrant that ProForge will be uninterrupted, secure or error-free, or that any Result will meet your expectations. Some jurisdictions do not allow these exclusions, so they may not all apply to you.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BURRAK AI LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF PROFORGE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR PROFORGE CREDITS IN THE TWELVE MONTHS BEFORE THE CLAIM. Nothing in these Terms limits liability that cannot be limited by law.

14. Ending your use

You can stop using ProForge at any time, and you can delete your account as described on the Delete Your ProForge Account page. We may suspend or end your access if you break these Terms, if your use creates risk or legal exposure for us or others, or if we discontinue ProForge. Provisions that by their nature should survive will survive.

15. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will tell you in the app before it takes effect. Continuing to use ProForge after that means you accept the updated Terms.
